Lesson 1 – Introduction

History of FIDIC organization and background to the development of standard contracts, specification of the construction environment, specification of construction projects and participants, introduction to the concept of modern construction contracts, introduction to different methods of project delivery, introduction to different types of FIDIC model contracts according to delivery method and price determination (remeasurement contract, design-build, turnkey contract, fixed price, variable price, etc.), procurement specifics, responsibility for design documentation, price determination (procurement issues), risk transfer to the contractor, risk allocation in Red/Yellow/Silver/Emerald Books.

Lesson 2 – Introduction to FIDIC General Conditions (Red and Yellow Books)

Contract structure (General Conditions, Particular Conditions, Letter of Acceptance, Letter of Tender, Specifications/Employer’s Requirements, Drawings, Forms, Tender, Appendix to Tender, Bill of Quantities, Health and Safety Plan), definitions, what’s new in the 2017 FIDIC General Conditions editions.

Lesson 3 – Rights and Obligations of Contracting Parties

Employer’s obligations, Contractor’s obligations, Engineer’s obligations, differences between Yellow, Red and Silver Books, inappropriate risk transfer, inappropriate interference with construction contracts (explanation of FIDIC golden principles).

Lesson 4 – Risk, Liability and Force Majeure, Claims (Basics)

What is risk, Max Abrahamson, unallocated risks, risk management, risk pricing, liability for damage, indemnity, explanation of the difference between liability for damages and indemnity, Employer’s risk events – ERE, Contractor’s risks events – CRE, excusable delay, compensable delay.

Lesson 5 – Time Management

DAAB decision-making procedure, standing and ad hoc DAAB, dispute prevention, burden of proof, decision (form, content), duration of DAAB dispute resolution, DAAB costs, advantages and disadvantages of DAAB.

Domestic arbitration proceedings before RSSAK, ICC Rules.
